DETROIT — Wayne County Circuit Judge Marianne O. Battani on Friday declared a couple the legal biological parents of an unborn child being carried for them by a surrogate mother.
The attorney for the couple said it was the nation’s first legal opinion on determining the parentage of a child conceived from the egg and sperm of a couple but carried by and born to a surrogate mother. The judge’s interim order will become permanent after blood tests after the infant’s birth.
