The U.S. attorney’s office said in Tampa that it intends to put former baseball star Denny McLain on trial again if necessary.
The U.S. 11th Circuit Court of Appeals ruled last week that McLain, 43, who has been imprisoned at the Federal Correctional Institute at Talladega, Ala., for 28 months, was denied a fair trial because of errors by Judge Elizabeth Kovachevich and federal prosecutors during the four-month trial.
But the prosecutors say there was nothing in the ruling that precluded McLain’s being retried on the drug and racketeering charges.
