A Delaware court dismissed a challenge to the state’s anti-takeover law sought by the investment group bidding for TW Services, which owns Denny’s coffee shops and El Pollo Loco restaurants. Coniston Partners said the U.S. District Court for Delaware rejected on procedural grounds its suit to have a portion of the law declared unconstitutional. The court said Coniston’s offer for TW Services is not affected by the Delaware law. Coniston said it was still “fully committed to acquiring TW Services and intends to continue to explore alternatives to meet that objective.”
