ITC Affirms Ruling Against Gemstar

The International Trade Commission dealt another blow to Gemstar-TV Guide International Inc., affirming an administrative law judge’s ruling against Gemstar in a critical patent case.
The ITC declined to review the judge’s finding that three Gemstar patents covering electronic program guides had not been violated by EchoStar Communications Corp. and two companies making cable TV set-top boxes, Scientific-Atlanta Inc. and Pioneer Corp.
Pasadena-based Gemstar, whose management is being shuffled by top investor News Corp., said it would appeal the ITC’s decision to the U.S. Court of Appeals for the Federal Circuit.
Meanwhile, the ruling is expected to help EchoStar, Scientific-Atlanta and Pioneer defend themselves against a patent infringement lawsuit that Gemstar filed in federal court in Atlanta.
News of the ITC’s decision was released after the markets closed. Shares of Gemstar closed at $4.22, up 29 cents, or 7%, on Nasdaq.
